I'm a mother of a disabled adult woman. I cared for her all alone the first 21 plus years. I have also been a professional HHA, PCA, PCT, Caregiver, incremental Med Tech for 20 plus yrs now. She entered the apd program and remained under their care for approximately 11 years. She returned to my care a little more than a month now. Neither her support coordinator or the group home owner is responding to my calls or messages. How do I I get paid ( care assistance ) through this program as her full time caregiver ? I need to find new medical specialists, a new day program ( that actually helps her ) etc...
I am sorry to say that I do not know much about the APD program in Florida. Our firm works mostly with Medicaid Waiver or Medicaid ICP. But you may want to file a complaint with the program directly. Does the penalty only apply to long term care or for medicare/medicaid dual plan holders?
Great question. The Florida Medicaid gift penalty does not apply to all Medicaid programs. If the Medicaid recipient has a D-SNP through QMB for example, there would be no gift penalty. But, be careful: it’s possible to be dually-enrolled on a program that would have a gift penalty. Also, consider whether its possible that the Medicaid recipient might need LTC services (at home or a facility) within 5-years. If so, better to use a non-gifting strategy to protect excess assets.
Are u allowed to have property out of state or would that be counted?
Yes, but only if it is rented out. Ill be doing another series of videos on how Florida Medicaid treats rental properties - stay tuned!

@@meshisha77 If property was co-owned with sibling for over five years - it is likely not considered a "countable asset" for Florida Medicaid eligibility purposes.

Do not recommend pace . The Pinellas Park location practices negligently and the medical care is so poor. If I didn't take things into my own hands of my own health, I would have died. I got out of that program within one month of being out of the hospital. I've never seen such poor knowledge and Medical Care in my life. The only Department that really was good was occupational therapy . I could have sued them for what happened to me but I'm too sick to even try to fight them. And I know what I'm talking about because I worked at East Boston Neighborhood Health Center PACE program. So I know how it's supposed to work. I was a home care nurse and home health aide supervisor and did multiple jobs in the pace Elder service plan of East Boston. They would be mortified if I told them what happened to me down here

Hello.could you please tell me what do I have to do because the social worker told me she is just able to approve 10 hours a week and my daughter depends 100 % on me ,can’t walk,bath ,go to bed by herself .Thank you.
If you want to get paid for these hours, ask that they enroll you in the Participant Directed Option (PDO) program. If you are looking for more hours, you need to request additional hours with medical support (i.e. doctor notes) that detail what your daughter needs. If this is denied there is an internal appeal process with the managed care organization. If that internal appeal is denied, then you request a fair hearing with AHCA.

And the social worker told me I could appeal because she was able to give me just 10 hours , I called your office on Monday to see if I have to hire your service , (I will have just 60 days to appeal ) but still waiting for someone to call me , thank you .
My mom is on Medicaid/disability And I’ve been taking care of her since I became an adult. And I’m 38 now she has mental disabilities is this something that I would be able to get.

But what about the homestead status meaning homestead of the residence. Can the property be sold for attorney fees if it's homestead residence. Not speaking of homestead exemption from creditors. I am a friend who inherited a homestead property. I understand that I don't get homestead exemption. But, does the property retain homestead status?
You would not get the same creditor protection as a friend.

He only has hypertension, cataracts (already had surgery), and arthritis. Never been hospitalized, non-smoker, does not drink alcohol. Is it possible to switch his Medicare Advantage Plan to Original Medicare with Medicaid as supplement insurance? We are trying to avoid PCP referrals needed with Medicare Advantage Plan and delayed care.

@elderneedslaw Attorney Jason Neufeld, my mother is low income and qualifies for Medicare and Medicaid in the State of Florida. I am currently in graduate school. In the near future, when I have a career I would be able to afford a private supplement insurance for her. In the future, would it be possible to switch her from Medicaid to a private supplement insurance? How complicated or difficult would that be? My mother is generally healthy. My mother only has pre-diabetes, hypothyroidism, and arthritis. Or if she has Medicaid, could I then add a private supplement insurance for her and keep the Medicaid (to hypothetically see Dr. Smith if he doesn't take Medicaid)?

Wouldn't an Enhanced Life Estate Deed with the beneficiaries being stated as "joint tenants with rights of survivorship" be effective even if one of the beneficiaries predeceases the grantor?
It depends on your goals. The revocable living trust is just going to provide more security for more unpredictable situations: for example, if one of the remaining joint tenants passes away, and that deceased child has their own children, using JTWROS can then unintentionally disinherit that familial line. In addition, any remaining co-owners after the original owner passes away, are now business partners. Meaning they all have to agree for anything to happen. Using a revocable trust avoids this. That being said, I really am not anti-ladybird deed, our office utilizes them frequently. But I always want to make sure my clients understand the pros and cons of all Florida estate planning strategies.

Would a protective trust harm social security in any way?
It depends on which type of Social Security. There’s Social Security retirement, supplemental security income (SSI), and Social Security disability income (SSDI). There is no negative impact to either Social Security retirement, or SSDI. However, with SSI, there are a few items that a special-needs trust should not pay for because it can result in a partial reduction of the SSI benefit (but vast majority of SNT distributions will not have any adverse impact).
Thank you for the explanation and the chart....I understand that the original owner of the house is excluded from the first $250k ($500k for couples) of the capital gain from selling the house; is it true that once the owner drafted a Lady Bird Deed and sell the house during their life time, the owner will no longer have that capital gain tax exclusion?
I have never heard that before. That being said, I am no tax expert. I’m going to ask a tax attorney colleague of mine. However, my initial instinct tells me that this would not be the case because using a ladybird deed is in fact, not a sale at all.
So if my Mom has assets (bonds and cash) in a brokerage account. and she wants to get Medicaid for memory care, it would be a 1st party trust in which when she passes the money has to be paid back to Medicaid for whatever they paid for. Is this correct?
That is correct. However, keep in mind that we have more than special need trust in our arsenal of Medicaid planning strategies.

You may want to consider calling the long-term care ombudsman. This is a free service offered by the state of Florida’s Department of elder affairs.

In an ALF, unfortunately, there is a component of the bill that Medicaid does not pay. So sometimes - a medicaid waiver recipient’s income + what medicaid pays an ALF is still insufficient.

With one exception: No way! Funds coming out of a Miller Trust can only be used for health/medical expenses for the Medicaid recipient.

How many hours per week at home?
There is no limit (but you may need to fight for more than 30-50 hours a week). Medicaid sometimes approves less than what is needed and an appeal is needed to get more hours.
Real quick, what if its a joint account with an ex spouses name on it. My parents divorced 20 years ago but my mom kept his name on her bank accounts. He hasnt put any money in thise accounts in decades, would medicaid still consider that his assets?
He should be removed. Normally this would be tantamount to a gift (which results in a penalty). However, when you can show that the money never belonged to the Medicaid applicant, you can successfully rebut that presumption.

You are absolutely correct. I wish I had a better answer. The way to get an improved experience would be if everyone started reporting the complaint to both the MCO and AHCA - every time (I know this isn’t a satisfying answer, but its the only way i can think of that might result in a change).

Great video - can you apply for all 3 savings programs to see which if any or you haven’t choose one and apply?
Usually: higher level Florida Medicaid programs give you all the benefits of lower-level Medicaid programs. For example, if you apply (and qualify for) QMB, you get all the benefits of SLMB and QI-1 PLUS additional benefits that come with QMB. So, you wouldn't need to apply for multiple programs.

My father in law passed away and he had qualifying individual premium assistance for his medicate part B. Does the recovery program try to recoup that assistance?
It depends on whether there is a probate, special needs trust, etc...
@@elderneedslaw He put his homesteaded property in a revocable trust. His daughter is the trustee. I believe it is irrevocable now that he has passed. However there is no probate.
How to take a course home to get paid for taking care of disabled parents
You do not necessarily need to take a course to get paid by the Florida Medicaid Waiver program to help take care of your disabled parents (although you may certainly do so).

My best friend has become disabled due to 6 strokes caused by medical malpractice she needs help with everything, I have worked as a caregiver for 35yrs for ppl who are developmentally disabled but this is all new to me never thought my fiance would become disabled, who can I contact for her to be her caregiver
